Health Policy News Summer Edition 2024
In our summer edition this year, we provide updates on key federal health policy developments that our subject matter experts have been following, with a focus on access to care. Our first article highlights key insights into the Medicaid and Children’s Health Insurance Program (CHIP) Managed Care Access, Finance, and Quality Final Rule, which includes provisions that seek to ensure access to care as well as promote quality and update financing rules. The second article of this summer edition publishes our Re-Entry Demonstration Waiver Tool-Kit. After following the progress and development of Medicaid re-entry services from California’s initial Medicaid Section 1115 Waiver and other leading states to CMS’s guidance, our team has compiled a toolkit of best practices.

Insights into the Medicaid and CHIP Managed Care Access, Finance and Quality Rule
The first article of our summer edition examines some of the most significant changes from the long-awaited Medicaid and Children’s Health Insurance Program (CHIP) Managed Care Access, Finance, and Quality Final Rule – access to care standards and monitoring, state website requirements, and changes to State Directed Payments, including what they mean for states and important timelines. At the same time that the Centers for Medicare and Medicaid Services released this final rule, they also released the Ensuring Access to Medicaid Services Final Rule. PCG subject matter experts will be hosting a webinar on both rules on Tuesday, July 30th at 2pm ET. The event will include a discussion on navigating the new landscape stemming from the rules, including insights and considerations for achieving compliance.

Best Practices Toolkit for Re-Entry Demonstration Waivers
In 2023, the Centers for Medicare and Medicaid Services (CMS) approved two Medicaid Section 1115 Re-Entry Demonstration Waivers, including California’s waiver, approved in January 2023, and Washington’s approved in June 2023. These waivers aim to provide access to key healthcare services to those transitioning out of the justice system. Following the approval of California’s waiver, CMS published a State Medicaid Director Letter (SMDL) to provide guidance to states wishing to similarly offer Medicaid reimbursable re-entry services under a Demonstration Waiver. CMS subsequently approved Medicaid Section 1115 Re-Entry Demonstration Waivers submitted by Massachusetts and Montana in the spring of 2024.
